Please read these Terms of Service carefully before using TubeScout. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By accessing, browsing, or using TubeScout ("the Service," "our Service," "we," "us," or "our"), whether as a guest or registered user, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

These Terms constitute a legally binding agreement between you ("you," "your," or "User") and TubeScout. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must immediately cease using the Service.

2. Description of Service

2.1 Current Status: Pre-Launch Phase

TubeScout is currently in pre-launch phase. The full service is not yet available to the public. By signing up for early access, you will receive notifications when the service becomes available and may be invited to participate in beta testing.

2.2 Planned Service Features

Once launched, TubeScout will provide the following features:

  • Daily Email Summaries: Automated daily email digests containing new videos from your YouTube subscriptions
  • AI-Generated Summaries: Brief, AI-generated summaries of video content to help you decide what to watch
  • YouTube Integration: Secure connection to your YouTube account to access your subscription list
  • Personalization: Ability to customize your digest preferences, including excluded channels and delivery times
  • Web Dashboard: Access to past digests and subscription management through our website

2.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Early Access and Beta Testing

3.1 Early Access Registration

By signing up for early access, you acknowledge and agree that:

  • The Service is not yet available and launch timing is subject to change without notice
  • There is no guarantee that you will receive access to the Service or be invited to beta testing
  • We may contact you via email with updates about the Service, beta testing invitations, and promotional offers
  • You may unsubscribe from these communications at any time

3.2 Beta Testing

If you are invited to participate in beta testing:

  • Beta Software: You understand that beta features may be incomplete, contain bugs, or not function as intended
  • No Warranties: Beta features are provided "as is" without any warranties or guarantees
  • Data Loss: We are not responsible for any data loss or corruption that may occur during beta testing
  • Feedback: We encourage you to provide feedback, but we have no obligation to incorporate your suggestions
  • Confidentiality: You may be asked to keep certain beta features confidential and not disclose them publicly
  • Termination: We may terminate your beta access at any time without notice

4. User Accounts and Registration

4.1 Account Creation

To use certain features of the Service, you must create an account. When creating an account:

  • You must provide accurate, current, and complete information
  • You must update your information promptly if it changes
  • You must be at least 13 years old (or the minimum age required in your jurisdiction)
  • You may create only one account unless expressly permitted by us

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use or security breach

We will not be liable for any loss or damage arising from your failure to maintain account security.

4.3 Account Termination

You may terminate your account at any time by contacting us at support@tubescout.app. Upon termination, your right to use the Service will immediately cease.

5. Subscription Plans and Pricing

5.1 Founding Member Pricing

We offer a special founding member pricing tier with the following terms:

  • Discounted Rate: Founding members receive a discounted monthly rate compared to regular pricing
  • Lifetime Lock-In: Your founding member rate is guaranteed for the lifetime of your active subscription
  • Rate Protection: If you maintain an active subscription, your founding member rate will never increase, even if we raise prices for new customers
  • Limited Availability: Founding member pricing is available only during the pre-launch and early launch period
  • Loss of Rate: If you cancel your subscription, you may not be able to re-subscribe at the founding member rate

5.2 Pricing Information

Current pricing for all subscription tiers is displayed on our website at the time of signup. We reserve the right to change pricing for new customers at any time with prior notice. Existing subscribers will maintain their current rate unless they cancel and re-subscribe.

5.3 Billing and Payment

  • Payment Processing: All payments are processed securely through Stripe, a third-party payment processor
  • Billing Cycle: Subscriptions are billed monthly on the anniversary of your subscription start date
  • Automatic Renewal: Your subscription will automatically renew each month unless you cancel
  • Payment Methods: We accept credit cards, debit cards, and other payment methods supported by Stripe
  • Failed Payments: If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your subscription may be suspended or canceled
  • Taxes: Prices do not include applicable taxes, which will be added to your invoice where required by law

5.4 Free Trial (If Applicable)

We may offer free trials at our discretion. During a free trial:

  • You will have access to the full service without charge
  • You must provide valid payment information to start a trial
  • Your subscription will automatically begin and you will be charged when the trial ends, unless you cancel before the trial period expires
  • We reserve the right to determine trial eligibility and may limit trials to one per user

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time:

When you cancel:

  • Your cancellation will take effect at the end of your current billing period
  • You will continue to have access to the Service until the end of your paid period
  • You will not be charged for subsequent billing periods
  • If you are a founding member and cancel, you may lose access to founding member pricing if you choose to re-subscribe later

6.2 Refunds

Refunds are provided at our sole discretion on a case-by-case basis. Generally:

  • No Refunds: All subscription fees are non-refundable except as required by law or as we determine in our sole discretion
  • Pro-Rated Refunds: We may provide pro-rated refunds for service outages or technical issues that prevent you from using the Service
  • Dispute Resolution: If you believe you are entitled to a refund, please contact us at support@tubescout.app with details about your issue
  • Payment Disputes: If you dispute a charge with your credit card company, we may suspend or terminate your account

7. YouTube Integration and Data Access

7.1 YouTube API Services

TubeScout uses YouTube API Services to access your YouTube subscription data. By using our Service, you agree to be bound by the YouTube Terms of Service.

7.2 Data We Access

When you connect your YouTube account, we will access:

  • Subscription List: The list of YouTube channels you subscribe to
  • Basic Account Info: Your YouTube username and profile information
  • Video Metadata: Information about new videos from your subscribed channels (titles, descriptions, thumbnails, upload dates)

We do not access:

  • Your watch history
  • Your private playlists
  • Your YouTube comments or interactions
  • The ability to post, modify, or delete content on your behalf

7.3 Data Usage

We use your YouTube data solely to:

  • Fetch new videos from your subscribed channels
  • Generate AI summaries of video content
  • Deliver daily email digests
  • Improve our Service

7.4 Revoking Access

You may revoke TubeScout's access to your YouTube data at any time via the Google security settings page. If you revoke access, the Service will no longer function, but your subscription will remain active unless you cancel it separately.

7.5 Google API Services User Data Policy

TubeScout's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

8. AI-Generated Content

8.1 AI Summaries

TubeScout uses artificial intelligence (AI) to generate summaries of YouTube videos. You acknowledge and agree that:

  • Accuracy: AI-generated summaries may not be 100% accurate and should not be relied upon as a substitute for watching the actual video
  • Interpretation: Summaries represent the AI's interpretation of video content and may differ from human interpretation
  • No Endorsement: Our summaries do not constitute an endorsement of the video content or the views expressed therein
  • Limitations: AI may misinterpret context, sarcasm, or nuanced content

8.2 Summary Improvements

We continuously work to improve the quality and accuracy of our AI summaries. Summary quality may vary and may improve or change over time as we refine our AI models.

9. Intellectual Property Rights

9.1 Our Content

The Service, including all content, features, functionality, software, designs, text, graphics, logos, and other materials (excluding User Content as defined below), is owned by TubeScout and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not:

  • Copy, modify, distribute, sell, or lease any part of our Service
  • Reverse engineer or attempt to extract the source code of our software
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use our Service to create a competing product or service

9.2 User Content and Data

You retain all rights to your YouTube data, email address, and other personal information you provide to us ("User Content"). However, by using the Service, you grant us a limited, non-exclusive, royalty-free license to use your User Content solely to provide the Service to you.

9.3 Third-Party Content

Video metadata, thumbnails, and descriptions are owned by their respective YouTube creators and are subject to YouTube's terms and conditions. We do not claim ownership of any third-party content.

9.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use, modify, and incorporate such feedback without any obligation to compensate you.

10. Acceptable Use and Prohibited Conduct

10.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.

10.2 Prohibited Conduct

You agree not to:

  • Illegal Use: Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Unauthorized Access: Attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks
  • Interference: Interfere with or disrupt the Service or servers or networks connected to the Service
  • Automated Access: Use any automated system, including robots, spiders, or scrapers, to access the Service without our permission
  • Circumvention: Circumvent, disable, or interfere with security-related features or features that prevent or restrict use or copying
  • Resale: Resell, rent, lease, loan, or sublicense access to the Service
  • Impersonation: Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Malicious Code: Upload, transmit, or distribute viruses, malware, or other malicious code
  • Account Sharing: Share your account credentials with others or allow others to use your account
  • Multiple Accounts: Create multiple accounts to circumvent limitations or restrictions

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to our collection and use of your data as described in the Privacy Policy, including:

  • Collection of your email address and YouTube subscription data
  • Use of cookies and analytics to improve the Service
  • Storage and processing of your data by third-party service providers (Firebase, Stripe, Resend, PostHog, Google)

12. Third-Party Services and Links

12.1 Third-Party Services

The Service integrates with and relies on third-party services, including:

  • YouTube: Video metadata and subscription data
  • Google (Firebase): Authentication and database services
  • Stripe: Payment processing
  • Resend: Email delivery
  • PostHog: Analytics
  • Google (Gemini AI): AI-powered video summaries

These third-party services have their own terms of service and privacy policies. We are not responsible for the content, accuracy, or practices of these third parties.

12.2 Links to External Sites

The Service may contain links to external websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

13. Disclaimers and Warranties

13.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13.2 No Guarantees

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF THE SERVICE WILL MEET YOUR EXPECTATIONS
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED
  • AI SUMMARIES WILL BE 100% ACCURATE OR COMPLETE
  • EMAILS WILL BE DELIVERED ON TIME OR AT ALL

13.3 Your Responsibility

You are solely responsible for:

  • Your use of the Service
  • Any decisions you make based on AI-generated summaries
  • Verifying important information by watching the actual videos
  • Compliance with all applicable laws and regulations

14. Limitation of Liability

14.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUBESCOUT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA
  • ERRORS OR INACCURACIES IN AI-GENERATED SUMMARIES
  • MISSED OR DELAYED EMAIL DELIVERIES

14.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

14.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless TubeScout, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Any claim that your use of the Service caused damage to a third party

This indemnification obligation will survive the termination of these Terms and your use of the Service.

16. Termination and Suspension

You may terminate your account at any time by:

  • You violate these Terms
  • Your payment fails or your account is past due
  • You engage in fraudulent or illegal activity

16.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account data after a reasonable period (see Privacy Policy for data retention details)
  • You will not be entitled to any refunds unless otherwise stated in these Terms
  • Sections of these Terms that by their nature should survive termination will survive

17. Changes to These Terms

We reserve the right to modify or update these Terms at any time at our sole discretion. When we make changes:

  • We will update the "Last Updated" date at the top of this page
  • We will notify you of material changes by email or through a notice on the Service
  • Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms

If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

18.2 Informal Resolution

Before filing a claim, you agree to contact us at support@tubescout.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good-faith negotiations.

18.3 Arbitration Agreement (If Applicable)

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

18.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND TUBESCOUT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TubeScout regarding the Service and supersede all prior agreements and understandings.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

19.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of TubeScout.

19.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.

19.5 Force Majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

19.6 No Agency

These Terms do not create any agency, partnership, joint venture, employment, or franchising relationship between you and TubeScout.

19.7 Notices

All notices and communications from us will be sent to the email address associated with your account. You are responsible for keeping your email address current. Notices sent by email will be deemed given 24 hours after email is sent, unless we receive notice that the email was not delivered.
